Terms of Service

1. Acceptance of Terms

By accessing or using the SiteICO platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service. We may update these Terms from time to time. Continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Accounts and Registration

To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update that information to keep it accurate. You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You must notify us immediately of any unauthorized access to or use of your account. SiteICO cannot and will not be liable for any loss or damage arising from your failure to comply with this requirement. Each account is for a single user. You may not share your credentials with any other person.

3. Billing and Subscriptions

The Service is offered on a subscription basis. By subscribing, you authorize SiteICO to charge your payment method on a recurring basis according to your chosen plan. All fees are in USD and are non-refundable except as required by law or as explicitly stated in our refund policy. You may cancel your subscription at any time through the Billing section of your dashboard. Cancellation takes effect at the end of the current billing period. We reserve the right to change our pricing upon 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new price. In the event of non-payment, we may suspend or terminate your account after a grace period.

4. Content and Acceptable Use

You retain ownership of all content you create, upload, or publish through the Service. By using the Service, you grant SiteICO a limited license to host, store, and serve your content for the purpose of providing the Service. You are solely responsible for your content and for ensuring it does not violate any applicable laws or third-party rights. Prohibited content includes, but is not limited to: illegal material, spam, malware, phishing content, content that infringes intellectual property rights, and content that promotes violence or discrimination. SiteICO reserves the right to remove content that violates these Terms and to suspend accounts that repeatedly engage in prohibited conduct.

5. Service Availability

We strive to maintain 99.9% uptime for all hosted sites. Scheduled maintenance windows, where required, will be announced in advance. Actual uptime may occasionally fall below this target due to circumstances outside our control, including upstream provider outages, natural disasters, and DDoS attacks. Service credits for downtime below our SLA targets are available on Pro and Business plans and must be requested within 30 days of the incident via our support channel. The Service is provided "as is" and "as available" without warranties of any kind.

6. Termination

Either party may terminate this agreement at any time. You may close your account at any time through the dashboard. Upon closure, all hosted sites will be shut down and your data will be retained for 30 days before permanent deletion, allowing time for you to export your data. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms, if required by law, or if we determine in our sole discretion that continued service would expose us to legal, operational, or reputational harm. Upon termination for cause, no refunds will be issued for prepaid fees.

7. Limitation of Liability

To the maximum extent permitted by applicable law, SiteICO and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. In no event shall our total cumulative liability to you exceed the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so some of the above limitations may not apply to you.

8. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or related to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
